In Ontario, children have the right to attend school even if they or their parents do not have immigration status in Canada.

But students and parents may not know about this right. They may also be afraid to go to a school to register.

What the law says

Children must attend school

In Ontario, the Education Act says that children must attend school. The only way that a child can be excused from attending school is for one of the reasons set out in the Act, for example, because they are sick.

A child who is 6 years old before the first day of school in September must go to school. Most children start school earlier by attending a kindergarten program when they are 4 or 5 years old.

Schools cannot refuse to admit children

It is against the law for a school to refuse to admit a child who is under 18 years of age only because the child or the child’s parent or guardian is in Canada without immigration status.

The Education Act says:

A person who is otherwise entitled to be admitted to a school and who is less than eighteen years of age shall not be refused admission because the person or the person’s parent or guardian is unlawfully in Canada. (Section 49.1)

The Ministry of Education has told school boards across the province that they cannot refuse to admit children only because their parents do not have immigration papers.

Schools should not refuse to admit children only because their parents do not have:

proof of immigration status or proof that they have applied for status
a work permit or social insurance number
Ontario Health Insurance Program (OHIP) coverage.

What the Immigration and Refugee Protection Act says

In Canada, the provinces have the power to make laws about education. But the Immigration and Refugee Protection Act also confirms children's right to go to school:

Every minor child in Canada, other than a child of a temporary resident not authorized to work or study, is authorized to study at the pre-school, primary or secondary level. (Subsection 30 (2))

This makes it clear that, for example, a child under 18 years of age who is claiming refugee status in Canada, or who has no status in Canada, does not need a study permit from Citizenship and Immigration Canada to go to school.

Canada's international commitment to education rights

Canada has signed the United Nations Convention on the Rights of the Child, which means that Canada has agreed to make primary and secondary education available to all children in Canada.

How you can help parents get their children into school

Students and parents may not know about their rights. They may also be afraid to go to their local school to register. As a community advocate, there are many ways you can help:

find out what school boards in your community are doing to welcome all children to their schools
tell people without status about children’s right to education
help children in non-status situations register for school
put up posters where newcomers gather and include local contact information about where they can get help registering children in school
coordinate with other agencies in your community that work with people who do not have status, for example, by sharing information about efforts to register children in local schools.
What will work best may be different across the province. Sometimes, it might help to make a phone call to a school on behalf of a parent. Other times, parents will need to have an advocate who understands the law go with them when they are registering their child.

Creating a poster

If you think it would be helpful, put posters in places where parents will see them. Here are some ideas about what information to include.

Your child has a right to go to school

You do not have to be a Canadian citizen or permanent resident.

If you need information or help to get your child registered at school, contact [insert name of your agency and contact information]

If possible, you may want to translate your poster into the languages that parents in your community will find easiest to understand.

If you know a child who has already tried but not been able to get into school, you might want to contact a lawyer or a community legal clinic.

Have you tried to enter Canada and were refused? Or do you think you may be refused if you try to enter Canada?  We know that it is a very stressful and disrupting experience.

You Have Options!

When it comes to being refused entry into Canada, it is important you deal with the situation properly. Whether you have a criminal record like a DUI or something even more serious, you may still be admitted into Canada as long as you have the ‘right’ paperwork in order.

You will most likely need to file a Temporary Resident Permit (TRP) application which is a ‘Form IMM 5708’.  Form IMM 5708 is the official document issued by a Canadian visa office that is placed in your passport to indicate that you have met the requirements for admission to Canada as a temporary resident (either as a visitor, a student, or a worker).

Reasons Why You Can Be Denied Entry to Canada:

There are a number of reasons you can be found inadmissible or refused entry to Canada, such as:

Security
Human or international rights violations
Criminality (even DUIs and DWIs)
Organized criminality
Health grounds
Financial reasons
Misrepresentation (of any kind)
Non-compliance with IRPA
Even having an inadmissible family member can cause you to be denied.

Normally, if you are inadmissible to Canada, you will not be allowed to enter, unless you know how to prepare the ‘right’ paperwork. If you have a ‘reason’ to travel to Canada that is justified in the circumstances, you may be issued a temporary resident permit (TRP).

Top 4 Questions We Get About TRPs:

1. Can I Apply for a TRP at the Canadian Border?

If you are a U.S. citizen or a citizen from a visa exempt country, you could apply for your TRP at the Canada/U.S. Border.  If you are approved, a ‘Temporary Resident Permit’ will be granted.

However, there are some risks to consider when applying for a TRP at the border or airport. You could be refused and turned away at the border. In some very unusual cases, you could be detained by the Canadian Immigration authorities (this is rare).

2. Can I Apply for a TRP at a Canadian Embassy?

In most cases, TRPs are submitted to a Canadian consulate or Canadian embassy for processing. If you are a U.S. citizen, you can apply for a TRP at a Canadian consulate in the United States. However, the downside for applying at a Canadian consulate rather than the border is that processing times for TRP applications at the Canadian consulate sometimes can take a number of months.

3. How Long Are Temporary Resident Permits Valid For?

The duration of your TRP varies depending on the circumstances of your case. TRPs can be valid for a number of months or years, and they could be for a single entry to Canada or for multiple entries to Canada.

4. What If My Criminal Offence Took Place Years Ago?

In certain cases, if your conviction occurred 5 years ago or longer, you may be eligible to make an application for Criminal Rehabilitation to enter Canada. A ‘Criminal Rehabilitation’ application (if approved) will wipe out your criminal inadmissibility that prevents you from entering Canada.  If you travel often to Canada, you may want to apply for this.

Note:  Unlike Temporary Resident Permits, an application for ‘criminal rehabilitation’ cannot be made at a Canada/U.S. border. You should make an application for criminal rehabilitation at a Canadian consulate or embassy.

Living Without Status in Canada? You May Have Options

An estimated 200,000 to 500,000 people are currently living without status in Canada. Many have lived under the radar for years, some since childhood. Others have more recently stayed beyond the validity of their temporary visitor, student or worker status—some without even realizing it.

Persons living without status in Canada on a long-term basis face difficult conditions. Those facing a medical crisis could be denied treatment. Though children without status are entitled to attend public school, some families keep them out due to fear or lack of information on their rights. Many of those who work illegally will experience poor conditions and even exploitation at the hands of their employers. Most stay silent, believing that speaking up could result in their removal from Canada.

Many live in constant fear of being discovered and ordered to leave. Others cannot be deported due to Canada’s suspension of removals to unstable countries such as Afghanistan and the Democratic Republic of Congo, but still cannot access work, education or healthcare due to their lack of legal status.

Even for those who manage to make a decent life for themselves and their families in Canada, the potential consequences of lack of legal status are serious. If discovered by the Canadian authorities, a removal order can be issued. This can lead to deportation and the denial of future entry to Canada.

Many of those living without status in Canada fear taking action to resolve their lack of status. The threat of deportation looms large. However, many people have more options than they realize, and could improve their living conditions significantly by taking steps to resolve their lack of status.

Available opportunities depend on a person’s specific circumstances, including the length of time they have been living in Canada, the reason for their lack of status, and their family situation. Options for resolving a lack of status in Canada might include:

Restoration of Status


Those who have stayed 90 days or less beyond the validity of their temporary status can apply to restore that status. It is possible to apply to restore the same type of status (e.g. application for a new study permit after an initial study permit expires), or to restore status under a new category (e.g. application for a work permit within 90 days of visitor status expiring).

After 90 days, the restoration of status option is lost. This deadline is strict. If more than 90 days have passed, it is usually advisable that a person leave Canada before their overstay is detected where this is a valid option.

Temporary Resident Permit


A Temporary Resident Permit can allow a person without status to remain in Canada temporarily. There must be compelling reasons to justify the person’s stay in spite of the lack of status. Valid reasons might include the hardship of family separation, a well-founded fear of harm in their country of nationality, or the need to carry out work in Canada that is beneficial to Canadians.

A Temporary Resident Permit is by definition a temporary solution. Permits are issued for a period of up to three (3) years, and can be renewed. However, a person who has stayed in Canada as a Temporary Resident Permit holder for a prescribed period may eventually become eligible for permanent residence.

Permanent Resident Applications


Some categories of permanent residence allow for a person to apply despite the fact that they are living in Canada without status. If an individual has a spouse or common-law partner who is a permanent resident or Canadian citizen living in Canada, that individual can be sponsored from inside Canada whether or not they enjoy valid status.

Another possibility is an application for permanent residence on humanitarian and compassionate grounds, known as an “H&C application”. This is a broad category that can be used to overcome various types of inadmissibility to Canada. In evaluating an H&C application, officers will consider the best interests of any children, family reunification, health issues, establishment in Canada, and potential hardships posed by return to the country of origin.

Note that a refused refugee claimant cannot apply for humanitarian and compassionate relief until one year has passed since the refusal of their refugee claim.

general Skilled Migration

Applicants who have skills in demand may be eligible to apply for a Skilled visa. Employer sponsorship does not apply to Skilled visas and you do not need to be working in your field of expertise. Requirements include english skills, qualifications and/or work experience and satisfaction of the points test criteria. It is important to keep in mind that requirements vary depending on each individual situation.

There are 3 different types of Skilled visas:

-Skilled Independent visa (Subclass 189)
-Skilled Nominated visa (Subclass 190)

Skilled Independent visa (Subclass 189)

The Skilled 189 visa is for skilled workers who are not sponsored by an employer or family member or nominated by a state or territory government. The Skilled 189 visa allows you to live and work anywhere in Australia as a permanent resident.

Skilled Nominated visa (Subclass 190)

The Skilled 190 visa is for skilled workers who are nominated by an Australian state or territory government agency. Sponsorship by an employer or family member is not applicable. This visa allows you to live and work in a particular Australian state or territory as a permanent resident.

Skilled Regional (Provisional) visa (subclass 489)

The Skilled 489 visa allows skilled workers to live and work in specified regional areas in Australia on a temporary basis initially. Sponsorship by a state regional body applies and the option to be sponsored by a family member may also apply if your relative meets specific criteria. Once you have lived and worked in a regional area for a specific period of time you can then obtain permanent residency.

Key features applicable to Skilled visas:

you  must nominate an occupation on the relevant skilled occupation list for the visa subclass you wish to apply for
you must prove that you have relevant skills for your nomination occupation, different criteria applies for each occupation
the best option for you will depend on your specific situation
you must not have turned 50 years of age, if you are over 50 other visa options may apply

The Subclass 186 visa consists of three different streams:

Obtaining skills assessments can be difficult as each skills assessing authority has different criteria, however in some circumstances the skills assessment requirement can be avoided depending on your situation.

RSMS Regional Sponsored Migration Scheme (RSMS) Subclass 187

The Regional Sponsored Migration Scheme (RSMS) is similar to the Employer Nomination Scheme,  however it is specifically for employers in regional and low population growth areas in Australia.

Similar to the Subclass 186 visa, in order for you to be eligible for a permanent RSMS Subclass 187 visa both you and your employer must meet specific criteria.

LMIA (FORMER LMO) LABOUR MARKET IMPACT ASSESSMENT AND WORK PERMITS FOR HIRING FOREIGN WORKERS IN CANADA

The Labour Market Impact Assessment LMIA  (former Labour Market Opinion (LMO) ) is a report issued by Employment and Social Development Canada that outlines the impact that hiring a foreign worker would have on Canada’s labour market. Employers need to obtain this assessment in order to hire foreign workers. If the assessment is positive, a report outlining the conditions of the job being offered by the employer, the names of the employees, and also the expiry date of the LMIA will be listed in the document issued by ESDC.

Some Canadian Permanent Residents May be Denied Entry to U.S. After Latest Order

Citizens of six specific countries who are also permanent residents of Canada may be barred from entering the U.S. after that country's President, Donald Trump, issued a new executive order on immigration.

Trump signed the order on March 6, though it will not be implemented until March 16. Under the order, citizens of Iran, Libya, Somalia, Sudan, Syria and Yemen are blocked from applying for U.S. visas for 90 days. It also blocks all refugees from entering the country for 120 days.

Dual citizens of one of these countries who also possess a passport from a country not on the list are exempt from the ban. In theory, this means Canadian dual citizens can travel as usual, but the status of permanent residents who want to cross the border is somewhat less clear.

The order explicitly states that a “landed immigrant” from Canada needs to apply for a “waiver” that “may” be granted, on a “case-by-case basis,” at the discretion of a consular officer or another official from U.S. Customs and Border Protection. This policy applies to a range of people, inclduing if "the foreign national is a landed Canadian immigrant who applies for a visa at a location within Canada."

It is not yet clear how this policy with respect to Canadian permanent residents will be applied. There is currently no official indication as whether the policy will be applied consistently across consulates in Canadian cities, or how generous the U.S. government may be to applicants.

On Monday, March 6, a spokesperson for Immigration, Refugees and Citizenship Canada (IRCC), said that “Canada will work with its counterparts in the United States to clarify the impacts of this order on Canadian citizens and Canadian temporary and permanent residents.”

After an earlier U.S. immigration order was signed and implemented on January 27, Canada's Immigration Minister, Ahmed Hussen, initially assured Canadian permanent residents who held a valid U.S. visa that their travel rights should not be affected. However, it soon became apparent that these assurances were not being met by some U.S. border officials. Soon after that initial ban was implemented, CICNews.com published a story regarding a Syrian permanent resident of Canada who was not only denied entry to the U.S, but also had his visa cancelled at the border.

Mr. Trump’s original order faced legal challenges in multiple courts, culminating in Seattle federal Judge James Robart issuing a temporary restraining order. A higher court in San Francisco upheld Judge Robart’s decision. Rather than continue with trying to re-implement the original ban, Mr. Trump decided to issue a new order.


BC Invites 377 Workers and Graduates to Immigrate in March 8 BC PNP Draw

A total of 377 candidates for immigration to British Columbia, Canada have been invited to apply to the British Columbia Provincial Nominee Program (BC PNP) in a draw that took place on March 8. This is the third such draw to have taken place in the last three weeks, with other candidates having been invited to apply on February 17 and February 23, respectively.

All Invitations to Apply (ITAs) issued on March 8 were issued across a range of BC PNP sub-categories managed under the Skills Immigration Registration System (SIRS), a unique system used to rank and select candidates under certain BC PNP sub-categories.

Some individuals issued ITA are now in a position to submit their BC PNP provincial nomination application through one of the enhanced BC PNP sub-categories aligned with the federal Express Entry selection system. The remaining candidates will have their applications processed outside the Express Entry system at the federal level.

Please note that the ITA with respect to the BC PNP is not the same as the ITA issued at the federal Express Entry level.

Similar to the previous draw, the the majority of ITAs issued on March 8 were issued to international graduates who had completed their studies in Canada.

Express Entry BC Stream

This stream of the BC PNP is aligned with the Express Entry system, and applications under this stream may receive priority processing at the provincial and federal levels. Consequently, individuals in this stream must be eligible for one of the three Federal economic programs — Federal Skilled Worker Class (FSW), Canadian Experience Class (CEC), or Federal Skilled Trades Class (FST) — in order to enter the federal Express Entry pool. Individuals in the Express Entry pool who have a provincial nomination certificate from BC receive 600 points under the Comprehensive Ranking System (CRS), which means the individual will receive in an ITA in a subsequent Express Entry draw.

Express Entry BC – Skilled Worker

The Express Entry BC – Skilled Worker category is for international skilled workers who have post-secondary education or training and employment experience in a professional, management, technical, trade or other skilled occupation. Express Entry BC – International Graduate

International graduates who have graduated from a Canadian university or college within the past two years may be eligible to apply under the Express Entry BC – International Graduate category. Interestingly, this category is open to eligible graduates who graduated from a university or college in any location in Canada; it is not restricted to graduates from BC universities and colleges. This category is also aligned with the federal Express Entry system.

This base category is open to workers with post-secondary education or training and employment experience in a skilled occupation. A job offer is required.

Skills Immigration – International Graduate

This category is for international students who have graduated from a Canadian university or college within two years of applying to the BC PNP. While applicants do not necessarily need prior work experience, applicants are required to obtain a job offer from a B.C. employer.

Skills Immigration – Entry Level and Semi-Skilled

This category is open to candidates who may not be eligible for other Canadian immigration programs, as it allows certain non-skilled workers to apply for permanent residence. Candidates must work in an eligible occupation within the tourism/hospitality, long-haul trucking, or food processing industries, or in a NOC skill level C or D occupation in the Northeast Development Region of the province.

New Global Talent Stream Will Facilitate Two-Week Work Permit Processing Time

The government of Canada has outlined details of the new Global Talent Stream of the Temporary Foreign Worker Program, which, among other initiatives, will establish a two-week standard for processing of work permit applications (and temporary resident visas when applicable) for highly skilled talent. The Global Talent Stream is scheduled to be operational as of June 12, 2017.

The stream is part of the government’s Global Skills Strategy, which aims to help innovative firms thrive, creating economic growth and good middle-class jobs.

With this initiative, companies in Canada will be able to bring in highly-skilled international workers quickly and efficiently. At this moment, the exact hiring situations that would be eligible for two-week processing times is in development. A Global Talent List of eligible high-demand occupations is being created in consultation with labour market experts and key stakeholders. This list is expected to be publicized in advance of the June 12 launch.

Canada’s tech sector is expected to benefit significantly. Speaking at the announcement of the Global Talent Stream in Toronto on March 9, Benjamin Bergen, Executive Director of the Council of Canadian Innovators, said that “The Global Skills Strategy will help high-growth Canadian technology firms by making it easier and faster to attract and acquire the global talent they need to scale up and compete on the world stage. Canada’s most successful innovators welcome the new two-week turnaround standard for work permit applications, the streamlined process for applications, and the continued efforts of the federal government in supporting Canada’s tech sector.”

The announcement was also attended by two federal cabinet ministers, namely Navdeep Bains, Minister of Innovation, Science and Economic Development, and Patty Hajdu, Minister of Employment, Workforce Development and Labour.

“Canada continues to compete in a global innovation race. As technologies become more widely available to everyone, the only competitive edge for countries and businesses is the distinctive talent and creativity of their people. While skilled immigrants are now identifying Canada as a country of choice in which to apply their knowledge and ideas, we also need to prepare our homegrown talent for a rapidly changing job market,” said Mr Bains.

For her part, Ms Hadju added that “Our government’s Global Skills Strategy will give employers a faster and more predictable process for bringing in top talent and new skills to Canada.”

In addition to the two-week processing time for certain work permits, the government will also create a dedicated service for companies looking to make significant job-creating investments in Canada. Further, the government will allow skilled foreign nationals working in Canada short-term (for instance, 30 days or less in a 12-month period) to work without a work permit. This latter measure will also apply to brief academic stays
